Prenuptial & Postnuptial Agreements

 

Understanding the Difference

 

Prenuptial Agreement (Prenup):
A prenuptial agreement is created and signed before a marriage takes place. It establishes how assets, debts, and financial matters will be handled during the marriage and in the event of a divorce.

 

Postnuptial Agreement (Postnup):
A postnuptial agreement is signed after a marriage has already been made official. It serves the same purpose as a prenup but is executed once the couple is legally married.

Registered Domestic Partnerships (RDPs)

In California, a Registered Domestic Partnership (RDP) grants many of the same rights and responsibilities as marriage under state law, including community property rules. However, it is not the same as being legally married, and it is not always recognized outside California.

If You Are Already in an RDP

  • If you registered recently or have been in a domestic partnership for months or years, you are already bound by community property laws similar to marriage.

  • You can still create an agreement now that clarifies how assets, debts, and financial matters will be handled within your partnership.

  • If you later decide to marry, this agreement can be reaffirmed or updated as either:

    • A Prenuptial Agreement (if signed before your marriage license is issued), or

    • A Postnuptial Agreement (if signed after your marriage is made official).
